1. Overview
These Website Terms of Use, Refund Policy, and Privacy Policy (collectively, the “Policies”) govern your access to and use of the websites, programs, products, services, content, and communications offered by IBI Spine Health LLC (“IBI Spine Health,” “Company,” “we,” “us,” or “our”), including without limitation totalbackpainrelief.com, ibispinehealth.com, and any related landing pages, portals, or digital properties we own or operate (collectively, the “Site”).
By accessing or using the Site, purchasing a product or program, submitting information to us, or otherwise interacting with our services, you agree to these Policies. If you do not agree, do not use the Site or purchase our products or services.

2. Important Health and Medical Disclaimer
The content made available through the Site, including videos, articles, educational materials, exercise demonstrations, coaching materials, emails, text messages, and program content, is provided for general educational and wellness purposes only.
Unless expressly stated otherwise in a separate written agreement, the Site and our online programs are not intended to provide medical advice, diagnosis, treatment, physical therapy, chiropractic care, or any other licensed healthcare service.
Nothing on the Site creates a doctor-patient, therapist-patient, physical therapist-patient, coach-client healthcare relationship, or any other fiduciary or clinical relationship.
You should always consult an appropriately licensed healthcare professional before beginning any exercise, rehabilitation, nutrition, supplement, or wellness program, especially if you are pregnant, nursing, recovering from injury or surgery, have chronic pain, numbness, weakness, neurological symptoms, cardiovascular conditions, dizziness, balance issues, or any other medical concerns.
Do not ignore or delay obtaining medical advice because of information you saw on the Site or in our programs. If you believe you may have a medical emergency, call 911 or seek emergency medical care immediately.
Your use of any exercises, movements, stretches, educational suggestions, or wellness recommendations is voluntary and at your own risk.

3. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to purchase products or services through the Site. By using the Site, you represent that you meet this requirement and that any information you provide is accurate and complete.

4. Services Provided
IBI Spine Health offers educational content, digital wellness programs, coaching-style support, physical products, supplements, and related services designed to help users better understand back pain, movement, recovery, and general wellness.
Descriptions of products and services on the Site are provided for informational purposes only. We reserve the right to modify, suspend, or discontinue any product, service, feature, price, or offering at any time, subject to applicable law.
We do not guarantee that any program, product, or service will produce a particular health outcome, symptom change, or result.

5. No Guarantee of Results
Individual results vary. Testimonials, case studies, before-and-after stories, endorsements, or success stories appearing on the Site or in our materials are examples of individual experiences and are not guarantees, warranties, or predictions of what any other user may achieve.

6. Account Registration and Security
Some portions of the Site or our services may require you to create an account, login, or password.
You agree to:
provide current, accurate, and complete information;
keep your login credentials confidential;
notify us promptly of any unauthorized use of your account; and
accept responsibility for activity occurring under your account.
We reserve the right to suspend or terminate accounts that contain false information, violate these Policies, or present security or legal risk.

7. Acceptable Use
You agree not to use the Site or our services:
for any unlawful, fraudulent, abusive, or harmful purpose;
to violate any law, regulation, or third-party right;
to interfere with the security, operation, or functionality of the Site;
to upload malicious code, viruses, or other harmful material;
to scrape, crawl, harvest, or extract Site data without our written permission;
to reproduce, resell, republish, or commercially exploit our content without authorization;
to impersonate another person or provide false information; or
to post or transmit content that is defamatory, obscene, infringing, threatening, harassing, or otherwise objectionable.
We may suspend or terminate access for violations of these Policies.

8. Payments, Billing, and Subscriptions
All prices are listed in U.S. dollars unless otherwise stated. By purchasing through the Site, you authorize us and our payment processors to charge the applicable amount, including taxes and shipping where applicable, using your selected payment method.
If you enroll in a subscription, installment plan, continuity program, autoship program, or recurring billing arrangement, you authorize us to charge your payment method on a recurring basis according to the terms disclosed at checkout or in your written order form.
You are responsible for providing valid payment information and updating it as needed.
If a payment fails, we may retry the charge, suspend access to digital services, delay shipment, or cancel your order.
We reserve the right to correct pricing errors, cancel orders, or refuse service where permitted by law.

9. Refund Policy
9.1 General Rule
Because IBI Spine Health may offer different categories of products and services, refund eligibility depends on what you purchased.

9.2 Physical Products
Unless a different policy is stated on the product page or checkout page, unopened physical products may be eligible for return within 30 days of delivery.

To be eligible for a return:
the item must be unused, unopened, and in its original packaging;
you must provide proof of purchase; and
you must contact us within the applicable return window for instructions.
We do not accept returns for items that are opened, used, damaged after delivery, missing components for reasons not caused by us, or otherwise ineligible under applicable law or product-specific terms.
Certain items may be non-returnable, including perishable goods, sanitary goods, hazardous materials, customized items, final sale items, or other products clearly marked as non-returnable at the time of sale.

9.3 Digital Products, Courses, and Programs
Unless otherwise stated in writing at checkout or in a separate written agreement, digital products, downloadable materials, online programs, and access-based educational content are non-refundable once access has been granted.
If you offer a product-specific guarantee, trial period, or satisfaction policy on a sales page or order form, that specific written offer will control for that purchase.

9.4 Coaching, Consultations, or Scheduled Services
If you purchase a live session, consultation, or coaching-style service, cancellations or rescheduling requests must be made at least 24 hours in advance unless a different rule is provided in your service agreement. Missed appointments or late cancellations may be non-refundable.

9.5 Recurring Programs and Autoship
For subscriptions, autoship, or recurring supplement orders, you may cancel future renewals by contacting us or using your account tools before your next billing date or processing cutoff.
Cancellation stops future charges only. Charges already processed are governed by the refund rules applicable to the product or service purchased.

9.6 Refund Processing
If a refund is approved, refunds are generally issued to the original payment method. Processing times may vary by payment processor and financial institution.

We are not responsible for shipping delays caused by carriers, weather, supply chain interruptions, incorrect addresses provided by customers, customs delays, or events beyond our reasonable control.
Risk of loss and title for physical products pass as permitted by applicable law and the shipping terms provided at checkout.

11. Intellectual Property
All content on the Site and in our products and programs, including text, graphics, branding, logos, videos, photos, audio, program materials, PDFs, downloads, designs, software, and compilations, is owned by or licensed to IBI Spine Health and is protected by copyright, trademark, and other intellectual property laws.

12. User Submissions and Testimonials
If you submit comments, reviews, testimonials, survey responses, feedback, photos, videos, or other materials to us, you represent that you have the right to submit them and that they do not infringe the rights of any third party.
Unless we agree otherwise in writing, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, display, adapt, publish, and distribute such submissions for business, marketing, customer service, training, and operational purposes.
If we want to use your name, likeness, detailed health story, or identifiable testimonial in advertising, we recommend obtaining separate written testimonial/media consent.

13. Third-Party Links and Tools
The Site may include links to third-party websites, platforms, software, payment processors, scheduling tools, analytics providers, social media platforms, or embedded content. We do not control and are not responsible for third-party content, privacy practices, policies, or services.
Your use of third-party services is subject to the terms and policies of those third parties.

14. Electronic Communications

15. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE, PRODUCTS, SERVICES, CONTENT, AND MATERIALS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR THAT ACCESS WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
We do not warrant that the Site will be free of viruses or other harmful components or that defects will be corrected.

16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IBI SPINE HEALTH AND ITS OFFICERS, DIRECTORS, OWNERS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO THE SITE, PRODUCTS, SERVICES, OR THESE POLICIES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE, PRODUCTS, SERVICES, OR THESE POLICIES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE SPECIFIC PRODUCT OR SERVICE GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

Nothing in these Policies excludes liability that cannot be excluded under applicable law.

17. Indemnification
You agree to defend, indemnify, and hold harmless IBI Spine Health and its officers, directors, owners, employees, contractors, affiliates, licensors, and service providers from and against claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

your use of the Site, products, or services;
your violation of these Policies;
your violation of any law or third-party right; or
your submissions, content, or conduct.

18. Termination
We may suspend or terminate your access to the Site or services at any time, with or without notice, if we believe you violated these Policies, engaged in fraud or misuse, created legal or security risk, or if suspension or termination is otherwise appropriate in our discretion and permitted by law.
Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, indemnification, dispute provisions, and privacy-related sections as applicable.

19. Governing Law and Dispute Resolution
These Policies are governed by the laws of the State of Iowa, without regard to conflict of law rules.
Any dispute arising out of or relating to the Site, products, services, or these Policies shall be resolved exclusively in the state or federal courts located in JOHNSTON IOWA, and you consent to personal jurisdiction and venue there, unless applicable law requires otherwise.
Optional arbitration version: If you prefer arbitration instead of court litigation, replace this section with an attorney-drafted arbitration and class action waiver provision that complies with current law.
